These Terms & Conditions constitute a legally binding agreement between GulfInCart and any individual or business accessing or using the platform.

GulfInCart operates from the Kingdom of Bahrain and provides marketplace services to users across Bahrain, Saudi Arabia, the United Arab Emirates, Kuwait, Oman, and Qatar, subject to service availability and applicable laws.

By registering, accessing, purchasing services, publishing listings, or otherwise using GulfInCart, you acknowledge that you have read, understood, and agree to be bound by these Terms and all applicable policies incorporated by reference.

If you do not agree to these Terms, you must discontinue use of the platform.

Users must be at least 18 years of age, possess the legal capacity to enter into binding agreements, and comply with the laws applicable in their respective jurisdictions.

Users agree to provide accurate, complete, and current information during registration and whenever requested for verification purposes.

Any person registering or operating an account on behalf of a business represents and warrants that they are duly authorised to act on behalf of that business.

GulfInCart reserves the right to request identity verification, commercial registration documents, business licences, or other supporting information and may refuse registration where eligibility requirements are not satisfied.

Users are responsible for maintaining the confidentiality of their account credentials and for activities conducted through their accounts, except to the extent resulting from GulfInCart's own breach of applicable obligations.

Users shall promptly notify GulfInCart of any suspected unauthorised access or misuse of their accounts.

Users must not create fraudulent accounts, impersonate other persons or businesses, or maintain multiple accounts for the purpose of circumventing restrictions or obtaining repeated promotional benefits.

GulfInCart may restrict, suspend, or terminate accounts where reasonably necessary to address suspected fraud, security risks, or violations of these Terms.

GulfInCart operates as an online advertising and classified marketplace facilitating contact between independent buyers, sellers, dealers, rental companies, and automotive-related businesses.

Unless expressly agreed otherwise in writing, GulfInCart is not a party to any purchase, sale, rental, leasing, financing, or service transaction entered into between Users.

GulfInCart does not acquire ownership of advertised vehicles or products and does not independently inspect, certify, authenticate, or guarantee their condition, ownership, legality, availability, or suitability.

All negotiations, payments, contractual arrangements, ownership transfers, delivery obligations, and disputes arising from transactions between Users remain the responsibility of the relevant parties.

Users are responsible for conducting appropriate due diligence before entering into any transaction.

Nothing in this section excludes any legal responsibility that GulfInCart may have under applicable law.

By submitting a listing or advertisement, the User represents and warrants that:

The information provided is accurate, lawful, and not materially misleading.

The User owns or is legally authorised to advertise the relevant vehicle, product, or service.

All photographs, videos, descriptions, and supporting materials are genuine or appropriately authorised.

The advertised price and material conditions are accurately represented.

The content does not infringe the rights of any third party.

Users are responsible for updating or removing listings when advertised items become unavailable or when information materially changes.

GulfInCart reserves the right to review, reject, request modification of, suspend, or remove content that violates these Terms, applicable laws, or platform guidelines.

Approval or publication of any listing shall not constitute verification, certification, or endorsement by GulfInCart.

Businesses registering with GulfInCart must possess all licences, registrations, permissions, and authorisations required for their activities in the relevant jurisdiction.

Businesses remain solely responsible for the accuracy of their commercial information, advertised products, services, prices, and representations.

GulfInCart may request documentation to verify a business's identity or registration status.

Any verification badge or similar designation indicates only that specified information has been reviewed in accordance with GulfInCart's verification procedures.

Such verification does not constitute a guarantee, recommendation, or endorsement of the business, its financial standing, products, services, or transactions.

GulfInCart may withhold or revoke verification status where supporting information is inaccurate, expired, misleading, or otherwise insufficient.

All paid listing packages, bulk listing packages, business subscriptions, and related services are subject to the fees, features, validity periods, usage limits, and conditions displayed at the time of purchase.

By purchasing or activating a package, the User agrees to the applicable package conditions.

Package entitlements are limited to the specified validity period and may not be transferred, exchanged for cash, or carried forward unless expressly permitted.

Unused entitlements shall expire at the end of the applicable validity period unless otherwise stated in the purchased package.

The submission of a listing does not guarantee its approval or publication.

For listing services requiring moderation, the publication period shall commence upon approval and activation, unless a different commencement rule is expressly disclosed at purchase.

Business subscription entitlements and advertising benefits are subject to the selected package's applicable conditions.

GulfInCart may revise package structures, fees, and benefits for future purchases and renewals, subject to applicable law.

Subscriptions and listing services expire upon completion of their applicable validity periods unless renewed in accordance with the available renewal procedures.

Renewal is not automatic unless the User has expressly agreed to an automatic renewal arrangement.

Users are responsible for reviewing and confirming the listings, advertisements, and benefits they wish to continue where such selection is required.

Any upgrade shall be subject to the additional fees and conditions disclosed before confirmation.

Where a downgrade is requested during an active subscription, the existing package benefits shall ordinarily remain effective until the end of the current paid period, and the revised package shall apply upon renewal.

Listings or advertisements exceeding the renewed package's limits may expire or become inactive at the end of the existing subscription period.

GulfInCart shall not be obliged to preserve expired or unused entitlements beyond their agreed validity period.

GulfInCart may offer free listings, complimentary subscriptions, discounted packages, promotional extensions, or other introductory benefits.

Such offers are subject to eligibility requirements, usage restrictions, promotional periods, and any additional conditions communicated at the time of the offer.

Introductory free listing benefits are limited to one redemption per eligible User, unless expressly stated otherwise.

GulfInCart may verify eligibility using account information and other lawful fraud-prevention measures.

Where an eligible business receives a complimentary multi-period subscription offer, the User must comply with the applicable renewal conditions to continue receiving the promotional benefits.

Complimentary services and promotional credits have no cash value and are not refundable or transferable unless expressly stated or required by law.

GulfInCart may modify or discontinue promotional offers for future participants without affecting benefits already contractually granted, except where permitted by applicable law or necessary to address misuse.

Users agree to pay all applicable fees displayed and accepted during checkout.

Fees may vary by country, service category, package, promotional period, and selected currency.

The applicable transaction currency, taxes, and mandatory charges shall be disclosed before payment confirmation.

Payments must be made through authorised payment methods supported by GulfInCart.

GulfInCart may engage third-party payment service providers to process payments, refunds, and related transactions.

Users warrant that they are authorised to use their selected payment method.

Services requiring payment shall not be activated until payment is successfully confirmed and any applicable approval requirements are satisfied.

GulfInCart reserves the right to investigate suspicious payments, payment reversals, or unauthorised transactions and may temporarily restrict associated services where reasonably necessary.

All refund and cancellation requests are subject to GulfInCart's Refund & Cancellation Policy and applicable consumer protection laws.

Payments for services that have already been activated are generally non-refundable, except where required by law or expressly permitted under the applicable refund policy.

Where a paid listing or advertisement is rejected and qualifies for a refund, the eligible amount shall ordinarily be credited to the User's GulfInCart Wallet within 24 hours following confirmation of rejection.

Wallet credits may be used toward eligible GulfInCart services in accordance with applicable Wallet conditions.

Eligible refundable balances may be withdrawn to an approved bank account where withdrawal services are supported, subject to verification and applicable legal requirements.

Any applicable bank charges, transfer fees, or payment processing charges may be deducted only where lawfully permitted and appropriately disclosed.

Complimentary credits, promotional benefits, and non-refundable entitlements are not redeemable for cash unless expressly stated or required by law.

GulfInCart may withhold or delay a refund or withdrawal where reasonably necessary to investigate suspected fraud, resolve payment disputes, or comply with legal obligations.

Nothing in these Terms restricts mandatory statutory refund or cancellation rights.

All advertising services are subject to the duration, placement conditions, creative requirements, and fees agreed at purchase.

GulfInCart reserves the right to review, reject, suspend, or remove advertisements that are unlawful, misleading, inappropriate, infringing, or otherwise non-compliant with its advertising policies.

Advertising positions may be shared among multiple advertisers, and advertisements may rotate or be displayed according to the platform's placement system.

Unless expressly guaranteed in writing, GulfInCart does not guarantee any specific number of impressions, views, enquiries, leads, conversions, or sales.

The purchase of advertising services does not grant the advertiser ownership of, or exclusive rights to, any advertising position unless expressly agreed.

Promotional placement services, including listing boosts and featured business placements, are subject to their stated eligibility, duration, and usage restrictions.

Users shall not:

Submit false, fraudulent, deceptive, or unlawful listings.

Advertise stolen, prohibited, or illegally obtained goods.

Impersonate individuals, businesses, or authorised representatives.

Create duplicate accounts or listings to manipulate platform services.

Infringe intellectual property, privacy, or other legal rights.

Misuse another User's contact information.

Send unsolicited, abusive, threatening, or fraudulent communications.

Manipulate listing visibility, enquiries, or promotional systems.

Attempt unauthorised access to GulfInCart's systems.

Introduce malicious software or interfere with platform security.

Use the platform for money laundering or other unlawful financial activities.

GulfInCart may investigate suspected violations and take proportionate action, including content removal, service restrictions, account suspension, or referral to competent authorities where appropriate.

GulfInCart may suspend, restrict, or terminate access where a User materially violates these Terms, engages in unlawful conduct, creates security risks, or repeatedly misuses the platform.

Where reasonably practicable, GulfInCart may provide notice and an opportunity to correct a violation.

Immediate action may be taken where necessary to prevent fraud, protect Users, preserve platform security, or comply with legal obligations.

Termination does not extinguish payment obligations or liabilities accrued before termination.

Any eligible refunds or remaining refundable Wallet balances shall be handled in accordance with the applicable refund policy and law.

Users may request account closure, subject to outstanding obligations and legally required record retention.

All GulfInCart trademarks, branding, software, graphics, website designs, and original platform materials remain the property of GulfInCart or its licensors.

Users shall not reproduce, distribute, modify, or commercially exploit such materials without prior authorisation, except as permitted by law.

Users retain ownership of content they lawfully upload.

By submitting content, Users grant GulfInCart a non-exclusive, worldwide, royalty-free licence to host, reproduce, format, display, distribute, and promote that content to the extent reasonably necessary for operating and marketing the platform.

Users warrant that they possess the rights necessary to grant this licence.

GulfInCart may remove content that infringes third-party intellectual property rights.

GulfInCart processes personal information in accordance with its Privacy Policy and applicable data protection laws.

By using the platform, Users acknowledge that their information may be processed for legitimate purposes associated with account administration, listing publication, payment processing, customer support, security, and platform operations, subject to applicable legal requirements.

Personal information may be shared with authorised service providers or other parties where necessary and lawful.

Cross-border processing and transfers shall be conducted in accordance with applicable data protection requirements.

Users may exercise their applicable privacy rights as described in the Privacy Policy.

GulfInCart provides its platform and services with reasonable care and skill as required by applicable law.

However, GulfInCart does not warrant that every listing is accurate, that every advertiser is trustworthy, or that any advertised vehicle, product, or service will meet a User's expectations.

GulfInCart does not guarantee uninterrupted access, error-free operation, successful transactions, or particular commercial outcomes.

Users acknowledge that dealings with independent buyers, sellers, dealers, rental providers, and service providers involve risks for which they are responsible to undertake appropriate checks.

These disclaimers apply only to the extent permitted by applicable law.

To the maximum extent permitted by applicable law, GulfInCart shall not be liable for losses arising from independent transactions between Users, misleading information supplied by third parties, undisclosed vehicle defects, or breaches of agreements to which GulfInCart is not a party.

GulfInCart shall not be liable for indirect or consequential commercial losses arising from the use of the platform, except where such exclusions are prohibited by law.

Nothing in these Terms excludes liability for fraud, wilful misconduct, or any other liability that cannot legally be excluded.

To the extent permitted by applicable law, Users agree to indemnify GulfInCart against reasonable third-party claims, losses, and expenses directly arising from their unlawful conduct, infringement of third-party rights, or material breach of these Terms.

This indemnification does not apply to losses caused by GulfInCart's own unlawful conduct or negligence to the extent liability cannot legally be excluded.

GulfInCart may amend these Terms to reflect changes in applicable law, platform operations, security requirements, or services.

Updated Terms shall be published on the platform with the applicable effective date.

Material changes shall be communicated where required by law.

If any provision is determined to be invalid or unenforceable, the remaining provisions shall continue in effect to the extent legally permissible.

These Terms, together with the policies expressly incorporated by reference and the applicable terms accepted at checkout, constitute the agreement governing the User's use of GulfInCart.

Failure by GulfInCart to enforce any provision shall not constitute a waiver of its right to enforce that provision subsequently.

These Terms shall generally be governed by the laws of the Kingdom of Bahrain, subject to mandatory laws and consumer protections applicable in the User's jurisdiction.

Users accessing GulfInCart from Saudi Arabia, the United Arab Emirates, Kuwait, Oman, or Qatar remain responsible for compliance with applicable local laws.

The competent courts of the Kingdom of Bahrain shall have jurisdiction over disputes involving GulfInCart, except where mandatory applicable law provides otherwise.

Users are encouraged to contact GulfInCart to seek an appropriate resolution before initiating formal legal proceedings.
